1. Agreement to Terms
These Terms of Service ("Terms") govern your use of therapydesign.com (the "Site") and any web design services provided by Therapy Design ("we," "us," or "our"), a business based in North Carolina, USA. By using the Site or engaging our services, you agree to these Terms.
2. Services
We design and build custom websites for therapists and independent practices. The exact scope, deliverables, timeline, and price for any project are defined in a separate written proposal or agreement between us and the client, which takes precedence over these Terms where the two conflict.
3. Quotes and Payment
Pricing shown on this Site (such as the typical project range mentioned on the homepage) is an estimate only. Final pricing is confirmed after a consultation and is set out in a project-specific quote. Payment terms, including any deposit, milestone payments, or final balance, will be specified in that quote.
4. Client Responsibilities
Clients are responsible for providing timely feedback, content (such as text, images, and branding assets), and any account access needed to complete the project. Delays in providing these can affect the project timeline.
5. Intellectual Property
Upon full payment, ownership of the final website design and code created specifically for the client transfers to the client, excluding any third-party assets, licensed fonts, stock imagery, or tools that remain subject to their own licenses. We retain the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing.
6. Compliance Disclaimer
We build websites with HIPAA and ADA/WCAG best practices in mind, but we do not guarantee that any website will be free from legal claims, audits, or regulatory action. Compliance with HIPAA, ADA, and other laws is a shared, ongoing responsibility, and clients should consult their own legal counsel regarding their specific compliance obligations.
7. Disclaimer of Warranties
The Site and our services are provided "as is." Except as expressly stated in a project-specific agreement, we make no warranties, express or implied, regarding the Site or our services, including any implied warranty of merchantability or fitness for a particular purpose.
8. Limitation of Liability
To the fullest extent permitted by law, Therapy Design will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our services. Our total liability for any claim arising from a project will not exceed the amount paid to us for that project.
9. Termination
Either party may terminate an active project as described in the project-specific agreement. Work completed and expenses incurred up to the termination date remain payable.
10. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any dispute arising from these Terms will be handled in the state or federal courts located in North Carolina.
11. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision.
